MyTWG MEMBERSHIP PROGRAMME TERMS & CONDITIONS
Application and use of MyTWG Membership Programme is subject to the following terms and conditions:
In these Terms and Conditions, unless clearly stated otherwise:
“Birthday Vouchers” refer to TWG Tea vouchers credited during the Members’ birthday month and issued under the Programme for Members’ redemption;
“Card” refers to the MyTWG Membership Card issued by TWG Tea;
“Member(s)” refers to all MyTWG Membership Card holders who have agreed to all the Terms & Conditions herein and registered for the Programme;
“Membership” refers to the membership under the MyTWG Membership Programme;
“MyTWG Membership Programme” refers to the privileges offered by TWG Tea to Members from time to time at TWG Tea’s absolute discretion, which shall include but not be limited to the issuance of cards, rewards, vouchers and offers;
“Online Shopping Terms and Conditions” refers to the terms and conditions governing the access to and use of the Website and shopping online for the products and services of TWG Tea;
“Programme” refers to the MyTWG Membership Programme;
“Reward” refers to the MyTWG reward discount which Members will receive when they have accumulated the required transaction value making purchases at TWG Tea Salons & Boutiques;
“Tea Salon & Boutique” refers to any TWG Tea Salon & Boutique, Tea Boutique, Travel Boutique, Shop-in-Shop or Tea Counter which is not a Concession;
“Terms” refers to the terms and conditions as set out herein for this Programme;
“TWG Tea” refers to TWG Tea Company Pte Ltd, its subsidiaries and affiliated companies, its representatives and employees and any third party empowered by TWG Tea to act on its behalf;
“Website” refers to the website of TWG Tea at https://TWGTea.com;
“Welcome Pack” refers to the user guide issued to Members and which contains information pertaining to but not limited to Members’ entitlement to privileges, benefits and discounts.
- MEMBERSHIP AND ELIGIBILITY
2.1. The Programme is a rewards programme offered by TWG Tea for customers residing in Singapore and worldwide, subject to the Terms set out herein. Membership is only by invitation and is limited to individuals, at one account per individual. Membership is not transferable or assignable and is personal to the Members. Sharing of the account is not permitted. A purchase is necessary for joining the Programme.
2.2. Employees, officers, directors, agents and representatives of TWG Tea and its affiliates are eligible for Membership but may be excluded from certain promotions. Membership is open only to individuals who have reached the legal age of majority in their respective countries of residence. By submitting an application for Membership, you agree (or, if you are a minor, your parent or legal guardian agrees) to be bound by the Terms and any modifications or amendments. Members will be issued with a membership card sent to the mailing address provided in the application form. TWG Tea will not be responsible for the non-receipt of the membership card by a Member or an offer or promotion due to incorrect information given by the Member.
2.4. Membership is void if prohibited by law in the country of the Member's residence, and subject to change as may be necessary to comply with such laws or regulations.
- EARNING AND REDEEMING PROGRAMME REWARDS
3.1. Under the Programme, every dollar transacted will be recorded when you purchase products (excluding the purchase of e-gift cards and gift cards, overseas duties, taxes and/or shipping costs) in all TWG Tea Salons & Boutiques in Singapore and online at the Website. You must provide a form of identification at the point of purchase to have your dollars spent credited to your MyTWG Account. The form of identification may consist of your MyTWG Membership Card, e-mail address, phone number, membership number, or full name.
3.2. Accumulated dollars spent will entitle you to different Rewards. Details of any Rewards available and how to redeem these Rewards will be reflected in the Member’s MyTWG account page, including any limits or conditions on redeeming Rewards.
3.3. Spend cannot be accumulated on purchases made using vouchers as payment.
3.4. Dollars spent in TWG Tea Salons & Boutiques in Singapore shall be credited to the Member’s MyTWG membership account within 5 business days. Dollars spent online at the Website shall be calculated on the net value of transactions excluding any applicable shipping charges, duties and taxes and shall be credited to the MyTWG membership account after the order has been shipped.
3.5. Purchases from the Website will qualify towards membership tier upgrade and/or renewal from the date that purchases are credited to the Member’s account.
3.6. Accumulated spend cannot be transferred to another Member’s Account. Without prejudice to any of TWG Tea’s statutory rights, TWG Tea may at its absolute discretion and at any time, without giving reason or prior notice, suspend the purchase accrual, rectify any error in any calculations and make any adjustments they deem fit to said calculations.
3.7. TWG Tea reserves the right to adjust any purchase accrual in connection with any Member’s Card. In the event of any dispute, TWG Tea’s decision is final and conclusive.
3.8. TWG Tea shall have the sole discretion to approve or reject any applicant as a Member. Upon approval by TWG Tea of any application for Membership, a card will be issued to each applicant approximately four (4) weeks after receipt of a completed application form.
3.9. The Programme is currently valid in Singapore and online at the Website and may become available in other countries from time to time as offered by TWG Tea.
3.10. Should a Member choose to enrol in the Programme via the Website, the Member’s country of membership is determined by the Member’s Country of Residence. For example, if a Member selects Singapore as their Country of Residence, the Member will automatically be enrolled under the Singapore Programme and the Member’s participation in the Programme will be subject to the terms and conditions specific to the Singapore Programme.
3.11. If the Member is an existing Member who belongs to a different membership country from the country she is shopping on the Website, the Members’ membership status will remain under her existing membership country.
3.12. Should a Member wish to change their country of membership, the Member will need to send their request by email to CustomerService@TWGTea.com.
- CHANGES, TERMINATION & REMOVAL FROM PROGRAMME
4.1. If for any reason this Programme is not capable of running as planned (including in the event of fraud or attempted fraud), TWG Tea reserves the right in its absolute discretion to modify the terms of the Programme including the Rewards and the Terms, or to suspend or terminate the Programme. In the event of such modification, suspension or termination, TWG Tea will notify the members of the Programme via email, as well as by communicating this on the Website. Members will not receive any compensation from TWG Tea in the event of modification or suspension of the Programme.
4.2. Any abuse of the Programme, failure to follow any of the Terms, Membership inactivity for 12 months or more, any misrepresentation or any conduct detrimental to the interests of TWG Tea, or fraud or attempted fraud, may subject Members to revocation of their Membership and will affect eligibility for further participation in the Programme.
4.3. If your Membership is revoked or otherwise cancelled (whether by you or TWG Tea in accordance with the Terms), or if the Programme is terminated, the accumulated dollars spent in your account will automatically set to null. TWG Tea will notify you via email prior to making changes to the Terms. For the avoidance of doubt, the Member shall not be entitled to any compensation in respect of such forfeiture.
4.4. The Terms may be amended by TWG Tea at any time without prior notice. It is your responsibility to check or review the Terms from time to time to keep informed of any changes. In the event that the Terms change, you may choose to cancel your Membership by sending an email to CustomerService@TWGTea.com.
- GENERAL CONDITIONS
5.1. The Card is a privilege card, and not a credit or charge card and must be presented before making a transaction. The Card is issued solely for the Member’s personal use and benefit and shall not be shared, transferred or assigned. The Card shall only be used in respect of Rewards specified under this Programme and in accordance with the Terms herein, and is not valid with other promotions, cards or discounts.
5.2. The current Programme implemented by TWG Tea shall be valid unless varied, modified or terminated by TWG Tea in accordance with the Terms.
5.3. Without prejudice to any of TWG Tea’s rights or remedies, TWG Tea may at any time, at its absolute discretion, and without giving any reason or notice, terminate this Programme or withdraw, cancel or invalidate any Card, Rewards, Birthday Vouchers and/or privileges without being liable to damages.
5.4. TWG Tea reserves the right at its sole discretion to change the Programme, Rewards, Terms and guidelines at any time without being liable therefore in damages.
5.5. In the event of abuse or fraud in respect of the Card, Rewards, Birthday Vouchers and/or privileges or in the event that the Member breaches any of these Terms, TWG Tea has the right to revoke and cancel the Card and withdraw all benefits and privileges conferred by the use of the Card without being liable therefore in damages.
5.6. TWG Tea shall not be liable if it is unable to perform or fail to perform its obligations under the Terms, where such delay or failure is caused by natural hazard and/or disaster, labour unrest, riot, civil commotion, lockout, fire, flood, earthquake, typhoon, war, acts of foreign enemies or perils of the sea or other perils and any cause or circumstance whatsoever beyond the control of TWG Tea.
5.7. In the event of a dispute arising out of in connection with transactions made with the Card under the Programme, the transaction records of TWG Tea relating to this Programme shall be deemed conclusive and binding on the Member. The decision of TWG Tea on all matters relating to this Programme shall be final and binding on the Members and no correspondence will be entertained.
5.8. Upon expiry of the Member’s Card, all benefits and privileges of Membership shall cease to apply.
5.9. The Terms refer to our Privacy Statement at https://TWGTea.com/policies/Privacy-Policy which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using the Card, you consent to such processing and you warrant that all data provided by you is accurate.
- MyTWG WELCOME PACK
6.1. New MyTWG members will receive a Welcome Pack which will be delivered to the Member’s registered residential address. The Terms, available online at the Website, shall form part of the Welcome Pack and TWG Tea may, at any time, at its absolute discretion and without giving any notice, alter or amend the Terms.
- RENEWAL AND REPLACEMENT
7.1. The Card will be valid as long as the Member’s account remains active unless it has been reported stolen or missing or has been revoked, cancelled or terminated earlier. TWG Tea may (but shall not be obliged to) at its sole discretion issue any Member with a renewal Card and all Rewards, Birthday Vouchers and privileges in connection thereto shall be governed by the Terms as may be amended from time to time.
7.2. Members shall take all reasonable precautions to prevent loss, pilferage, theft, or unauthorized use of the Card. The Member will have to immediately notify TWG Tea orally and in writing if the Card is lost, stolen, mutilated, not received when due or if the Member suspects that the Card is being used by any other person. The Member shall be liable for any unauthorized use of the Card to the extent permitted by law and shall indemnify TWG Tea against any claims, losses or damage of whatsoever nature arising out of or in connection with any unauthorized use of the Card. If the Card has been reported lost or stolen and is subsequently retrieved, it must not be used. The retrieval of the Card that has been reported lost or stolen must be immediately reported to TWG Tea and it must be cut in half and returned to TWG Tea. Members should immediately report any loss or stolen Cards to the applicable Customer Service department in writing, at any Tea Salon & Boutique, via fax or email at CustomerService@TWGTea.com.
7.3. If the Card is lost, stolen or mutilated, TWG Tea may affect or impose an administration fee for the replacement of the Card and any subsequent replacements shall be subject to the Terms. For all members, a service fee of SGD10 will be charged for replacement of the lost or stolen Card.
7.4. In the event the Member wishes to terminate his/her membership to this Programme, the Member may do so by notifying the applicable Customer Service department in writing, at any Tea Salon & Boutique, via fax or email at CustomerService@TWGTea.com.
7.5. Replacement of Cards will not affect the Members spend which Members have previously accumulated. Members will be able to retain their spend and continue to accumulate new purchases with their new Card, provided replacement is within expiration duration.
- ISSUANCE OF BIRTHDAY VOUCHERS
8.1. A Birthday Voucher will be credited during the Member’s birthday month and will have a validity of 30 days. The Member can use the Birthday Voucher on regular or sale items, but it can only be used in Singapore or within their local country of membership.
8.2. Birthday Vouchers may only be redeemed for purchases made at any Tea Salon & Boutique within the issuing country or online at the Website.
8.3. For purchases made at Tea Salons & Boutiques, if an item was paid in part with a Birthday Voucher and the Member seeks a refund/return of the item, the value of the Birthday Voucher that was used in the purchase will be forfeited. If an item was paid in part with a Birthday Voucher and the Member seeks to exchange an item, the value of the Birthday Voucher can be credited to the new item. However, any excess value will be forfeited.
8.4. For purchases made online at the Website, if an item was paid in part with a Birthday Voucher and the Member seeks either a refund/return of the item or would like to exchange an item, the value of the Birthday Voucher will be forfeited.
- OTHER OFFERS
9.1. Membership in the Programme may entitle you to various offers ("Offers") in addition to Rewards. The details of these Offers will be communicated by email, SMS or by phone, depending on the communication channels chosen by the Member. Details and terms of any Offers will be defined in the Terms & Conditions of the Offer.
9.2. TWG Tea may extend Offers from time to time provided by third-party merchants (“the Merchant”). There shall be no refund or exchange, in any form whatsoever of the value of the goods and/or services offered by the Merchant. All Offers are subject to availability.
9.3. All Offers must be taken as given and collected/redeemed in the country where the Membership Card is issued. Members must agree to abide by the rules and regulations governing acceptance of the Offers prior to accepting the Offers.
9.4. If the Merchant is, for any reason, unable to supply the privileges or benefits stated in the Offers, the Merchant may in its absolute discretion supply alternative privileges or benefits of similar quality and price or withdraw the said privileges and benefits. TWG Tea may also, in its absolute discretion, at any time and from time to time without prior notice, vary the Offers featured or substitute one with another of similar value and to withdraw or vary the privileges and benefits under the Programme.
9.5. Each Member acknowledges that any dealings with any Merchant shall be strictly between the said Merchant and Member only and each Member agrees that TWG Tea shall in no way whatsoever be responsible for any loss, cost, damage or expense suffered by the Member in respect of: Any failure, act and/or omission, or default on the part of any Merchant to supply any rewards, products and/or services, privileges and benefits whatsoever under the Programme; any or all aspects of the products or services provided under this Programme supplied by the Merchant or third party operators, service provider or suppliers, if any, engaged by TWG Tea as participating Merchant under the Programme to provide such rewards.
- LIMITATION OF LIABILITY
10.1. To the fullest extent permitted by applicable laws, TWG Tea will not be liable for any damages of any kind arising out of or in connection with your participation in the Programme or Membership, whether under contract or tort or otherwise, including damages arising out of changes to or termination of the Programme or as a result of you redeeming and/or using a Reward or arising from your access to or use of or the inability to use the Programme or its contents. This applies to all damages of any kind, including but not limited to direct, indirect, incidental, punitive or consequential damages, costs, loss of data, income or profit, inability to use or access the Programme, loss of opportunity, loss of or damage to property and claims of third parties.
10.2. To the maximum extent permitted by law, the limitations on TWG Tea's liability set forth herein shall apply whether for breach or repudiation of contract, or whether in tort, civil liability by way of negligence, gross negligence, strict liability, or otherwise, even if advised of the possibility of such damage. By agreeing to the Terms, you willingly agree (or, if you are a minor, your parent or legal guardian willingly agrees) that you have relinquished your right to seek these damages from TWG Tea and that this is a reasonable allocation of risk. Certain legislation, including the Sale of Goods Act and Consumer Protection (Fair Trading) Act and Unfair Contract Terms Act may impose consumer guarantees or imply warranties or conditions or impose obligations upon TWG Tea which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. The Terms must be read subject to these statutory provisions.
10.3. Failure by TWG Tea to enforce any of the Terms shall not constitute a waiver of that provision. TWG Tea makes no guarantees, warranties, or representations of any kind concerning the Programme.
10.4. Some jurisdictions do not allow some of the above limitation of liability so such limitations do not apply to you.
11.1. TWG Tea collects personal information such as your name, email address, birth date, gender, address, contact information, occupation, credit card and other payment information, and personal interests and preferences (“Personal Information”).
- INTELLECTUAL PROPERTY
Intellectual property rights (including, without limitation, copyright, trademarks, patents, design rights and all other forms of intellectual property rights existing in the world) of all Programme contents and all software used in connection with the Programme is the property of and are owned by TWG Tea or licensed to TWG Tea related companies or its affiliates. Nothing in the Terms constitutes a transfer or a grant of a license or a right to the use of any intellectual property rights. Unless otherwise indicated on a particular part of the Programme materials, permission is granted to electronically copy and to print in hard copy portions of the Programme materials for the sole purpose of accessing the Programme and the services provided therein for personal use. Any other use of Programme materials - including reproduction, modification, distribution, republishing, transmission, display or performance - without the prior written permission of TWG Tea is strictly prohibited.
- APPLICABLE LAW
The Terms shall be governed by, and shall be construed in accordance with the laws of Singapore and you agree to submit to the jurisdiction of the Singapore courts. Where the Terms have been translated into other languages for your reference, please note that in the event of any inconsistencies, the English version of the Terms will prevail.
Any dispute, difference, controversy or claim between you and TWG Tea arising out of or in connection with this Website and the Terms shall first be submitted to the Singapore Mediation Centre for resolution by mediation in accordance with the Mediation Procedure for the time being in force. You agree to participate in the mediation in good faith and undertake to abide by the terms of any settlement reached.
